Zinester's Compliance to U.S. Federal CAN-SPAM Law
The so-called U.S. CAN-SPAM law was signed on December 16, 2003 and
will take effect on January 1, 2004. Three important things have to be
outlined:
First, the new law will override all state laws on commercial
email, some of which have even lead to panic among newsletter
publishers (the famous California law).
Second, the law clearly defines commercial email and does not
mix it with email newsletters, even if they contain ads.
Third, the law does not allow individuals to sue email senders
- only governmental or law-enforcement agencies are allowed to do so.
Herein, Zinester states that its system fully fits
the requirements issued by the new law:
1. Zinester is a double opt-in mailing
list service.
2. Zinester uses clear RFC-compliant
headers.
3. Every message includes a working
unsubscribe link.
4. Unsubscribe requests are probably the
most honored in the industry. We process each and every message that
comes in when someone clicks Reply on any of our newsletters (except
for those where a publisher had chosen to receive all the responses
himself). If that reply is an unsubscribe request, it is processed
immediately - usually less than one business day (10 are required by
the law).
5. Every message send through Zinester
is personalized (no bulk emailing!) and includes an RFC
List-Unsubscribe header, which contains a single-click unsubscribe
link. Some email clients link to this header via the interface. Should
be implemented in more clients, in our opinion, and should be a
requirement for mailing list services.
